Ms. Martinet discusses Gardner v. Cafepress Inc., a US District Court decision that could re-launch the debate over the definition of “service provider” under the DMCA,  and  the European Court of Justice landmark decision in In Case C 314/12,  UPC Telekabel v Constantin Film, which confirmed the validity of orders requiring an ISP to block access to infringing content.
