The Personal Care Products Council Legal and Regulatory Conference is the premier annual meeting for industry general counsel and legal staff, regulatory affairs staff, and outside counsel representing member companies.

The event will feature some of the country’s most prominent attorneys providing expert insight and analysis on a variety of topics.

On May 6th, Kelly McCarthy and Richard Nelson present “The Two Towers Of Evil: Fighting Gray Market And Counterfeiting In The Personal Care Industry”

Brand enforcement is a fight against internal and external forces and the personal care industry is an attractive target. On one side there are countless parties making and selling counterfeits in a myriad of venues and marketplaces. On the other, there are parties maneuvering authentic products out of approved  supply chains and into the hands of customers in ways and at prices you never intended. Both forces attack your brand, and no brand protection program can be truly effective without a thoughtful and holistic approach. Focusing on one tends to drive your adversary to the other (i.e., if you only focus on counterfeits, the illegal gray market will flourish). Whether your brand protection efforts are just getting started or are well established, this program will outline best practices for simultaneously dealing with both types of threats, including transactional/non-litigation as well as civil and criminal litigation solutions.
